Eviction & Possession Claims: Insurance That Covers Legal Costs
Getting a tenant out is often the most expensive, stressful part of letting a property. Here is what your landlord insurance should pay for, what it usually won’t, and how the rules changed in England on 1 May 2026.
Legal expenses cover and rent protection can each help, but neither pays automatically. The wording of your policy, the eviction ground you rely on, and the way you handle the claim all decide whether you are paid.

What Changed in England on 1 May 2026
The Renters’ Rights Act 2025 abolished Section 21 “no-fault” evictions in England from 1 May 2026. Possession now runs through Section 8 of the Housing Act 1988, and you must rely on one or more statutory grounds set out in the Act’s schedule. Notice periods for many grounds are longer than they were under Section 21.
From 1 May 2026, a landlord in England must prove a statutory ground for possession. Wanting the property back is no longer enough on its own.
Summary of the Renters’ Rights Act 2025 changes
For landlords with a claim already underway, transitional rules apply. Section 21 notices served before 1 May 2026 could only proceed to court if proceedings were issued by 31 July 2026. Any claim still open should be checked with a solicitor against the current gov.uk guidance.
Eviction Claims: The Real Cost Picture
Eviction costs vary widely, but the main cost drivers are the same: court fees, solicitor fees, bailiff costs and, where the tenant defends the claim, the time and expense of a contested hearing.

Figures are indicative benchmarks for planning only. Actual costs depend on the ground relied on, court, solicitor and the length of the process. Check your own policy schedule for limits, excesses and any waiting periods.
Five Things Your Eviction Cover Should Include
Legal Costs
Solicitor and Court Fees for Possession Proceedings
Good legal expenses cover pays for the solicitor who issues and runs the possession claim, plus the court fees. Many policies use a panel of approved solicitors, so check whether you can use your own.
Enforcement
Bailiff and Warrant Costs
Even after a court order, you may need a warrant of possession and bailiff attendance. Check whether enforcement costs are covered and whether there is a limit per claim.
Lost Rent
Rent Protection During the Process
Rent protection pays lost rent while you recover the property, usually subject to a waiting period and a monthly and total limit. Guide 1 covers how these typically operate.
Notification
Reporting the Claim on Time
Legal expenses policies normally require prompt notification of a dispute. Waiting too long to report can allow an insurer to decline cover, even where the claim is otherwise valid.
Rent Arrears
Arrears Are Not Always Covered
Legal expenses cover is usually for disputes about your rights and property, not for simply chasing unpaid rent as a debt. Arrears cover is a separate question and depends on your policy.
Checklist: Before You Start an Eviction
- Identify the correct ground. Under Section 8, the ground must match your evidence. Mandatory grounds such as serious rent arrears give the court less discretion than discretionary grounds.
- Serve the correct notice with the right notice period. Defective notices are one of the most common reasons possession claims fail or are delayed.
- Notify your insurer early. Do this before you instruct a solicitor, and use the insurer’s panel if the policy requires it.
- Keep a complete rent and communications record. Dates, payments, letters and messages are the evidence the court and insurer will ask for.
- Check your tenant’s position. Confirm the tenancy type, the deposit protection and the Information Sheet requirements under the 2025 Act.
- Plan for enforcement. A court order is not the end of the process. Check bailiff and warrant costs in advance.
Portfolio Perspective: One Eviction Can Hit Your Whole Income
Consider a landlord with eight flats producing £7,200 a month in rent. If one tenant stops paying and the eviction takes six months to complete, that property alone has produced no income for half a year. The legal costs come on top of the lost rent, and the other seven flats must cover the gap.
This is why portfolio landlords should look at aggregate limits: how many claims the policy allows per year, whether the limit is per claim or in total, and whether repeat claims on the same property are accepted.
Tenant arrears tend to rise during periods of financial pressure. A portfolio policy with a single annual claim limit can leave a second problem tenancy uninsured in the same year.

Eviction Insurance: Questions to Ask Before You Renew
- Does the policy cover possession proceedings in full, or only up to a set amount?
- Can I choose my own solicitor, or must I use the insurer’s panel?
- Is enforcement (bailiffs and warrants) covered, and is there a cost limit?
- What is the waiting period before rent protection pays?
- How many claims are allowed per year across the portfolio?
- Are arrears claims covered, or only disputes about possession?
